Under the Thailand Copyright Act, copyright protection covers a wide range of creative works, including literature, theatre, art, music, and audiovisual and cinematographic contents, as well as sound recordings and broadcast sound and video. It’s important to note that copyright does not extend to ideas, procedures, processes, systems, methods of operation, or any concept, principle, discovery, or scientific or mathematical theory.

The duration of copyright protection in Thailand is designed to last for 50 years after the death of the creator. However, for applied arts, the copyright protection is only valid for 25 years from the date of the creation or publication, if the work is made public during the creator’s lifetime.

Although the law does not require formal registration for copyright to be effective, proactive registration provides a definitive proof of ownership. We strongly recommend our clients file a notification of copyright with the Department of Intellectual Property (DIP). This straightforward process typically concludes within a couple of months and results in a copyright notification certificate. This certificate is an essential tool for opposing any third-party claims or addressing potential copyright infringement, which can sometimes occur without the infringer’s realization of committing plagiarism or breach of copyright.
