Deadlines adjustment for trademark and patent in Thailand due to COVID-19
It is possible to request an exceptional time extension on the basis of the global health crisis. This request needs to meet the following requirements:
1. It should be introduced at the latest within 15 days following the date where exceptional circumstances (such as lockdown) have ceased, OR before the actual deadline.
2. The applicant needs to provide evidence that the health emergency situation made it impossible to conduct business as usual and comply with existing deadlines (e.g. medical certificate if the applicant/staff of the company has been infected by COVID; administrative decree ordering local/national lockdown, etc.).
However, the time extension is valid only for 30 days, and there is no absolute guarantee that the Department of Intellectual Property will actually allow the deferment – although it is granted in most cases.
