The Thai Department of Intellectual Property reminds e-commerce entrepreneurs of existing fast-track trademark registration pathway
Commercial activities are conducted through a variety of channels, spanning both offline and online markets. In recent years, rapid technological development and the widespread adoption of the internet and digital devices have significantly transformed the business landscape. As a result, entrepreneurs increasingly focus on operating through electronic channels, which offer broader market access, greater cost efficiency, and more streamlined management of sales, marketing, and customer engagement, enabling businesses to reach a wider and more diverse customer base.
Following the introduction of the fast-track system registration pathway in 2023, the Thai Department of Intellectual Property (DIP) re-launched this initiative in December 2025, targeting trademark registration for e-commerce entrepreneurs, namely, individuals or legal entities that conduct business by selling goods or providing services through electronic systems or digital platforms.
To request fast-track examination, entrepreneurs are required to comply with the following requirements:
(1) The application must be submitted via the DIP e-filing system;
(2) The application must be a single-class application covering no more than ten items;
(3) The applicant must submit, together with the application, search results for identical or similar prior marks; and
(4) The applicant must provide a document, in the Thai language, setting out the reasons why examination of the trademark application should be expedited (for example, a marketing plan demonstrating use of the trademark in connection with products offered through online platforms).
If the DIP considers that the application meets the prescribed requirements, the application will be examined, and the first office action will be issued within four months. If the application does not meet such requirements, it will be examined under the general examination timeline, which is approximately ten months to one year.
In light of the rapid transition toward electronic commerce, this particular announcement aims to encourage entrepreneurs who operate their businesses through electronic channels to initiate trademark registration procedures. It should, however, be noted that this fast-track procedure is subject to the same conditions as the previous fast-track procedure introduced in 2023, which is open to all types of businesses. One might therefore question the practical added value of this new announcement, given that e-commerce entrepreneurs were already eligible under the existing framework.
