Natthaphan Benkhan

Natthaphan is a Senior Associate at TMP Intellectual Property and an experienced intellectual property lawyer whose practice focuses on trademark and copyright disputes, enforcement, and litigation. He represents Thai and international clients in complex proceedings before the Department of Intellectual Property, the Trademark Board, the Central Intellectual Property and International Trade Court, and Thailand’s appellate courts.

His trademark practice covers the full range of contentious matters, including appeals against decisions of the Trademark Registrar, oppositions, cancellation and invalidation actions, ownership disputes, and infringement proceedings. He develops strategies based on the strength of the client’s rights, the available evidence, and the commercial importance of the brand, providing clear and practical advice from the initial assessment through the final resolution of each matter.

Natthaphan also has substantial experience in copyright protection and enforcement. He advises clients on copyright ownership, unauthorized reproduction and use, online and offline infringement, evidentiary issues, and available enforcement remedies. His understanding of both substantive intellectual property law and court procedure allows him to manage legally complex matters while remaining focused on commercially effective outcomes.

As an experienced litigator, Natthaphan handles every stage of intellectual property disputes. His work includes conducting factual and legal assessments, developing litigation and enforcement strategies, preparing pleadings and written submissions, collecting and reviewing evidence, preparing witnesses, appearing at hearings, conducting settlement negotiations, and managing appeals. He is particularly skilled at transforming complicated factual records and legal issues into focused, persuasive arguments before administrative authorities and the courts.

In addition to formal proceedings, Natthaphan advises clients on pre-litigation strategy, potential exposure, enforcement options, and the resolution of disputes before they escalate. He works closely with brand owners, rights holders, investigators, and other relevant parties to coordinate effective action against infringement while protecting clients’ broader commercial interests. His practice encompasses matters involving both traditional and digital channels, where unauthorized use and infringement can develop rapidly across multiple platforms.

He holds an LL.M. in Public and International Law from the University of Melbourne, an LL.M. in Criminal Law and an LL.B. with Second-Class Honors from Thammasat University, and a B.A. in English from Mahidol University.
