Trademark availability search using an image file

There is an important matter to consider when filing a trademark application: pursuant to Article 6 of the Thai Trademark Act, a registrable trademark must not be identical or similar to a previously filed trademark application.
 
In Thailand, the availability of a trademark may be verified through the online database of the Department of Intellectual Property (DIP) at https://search.ipthailand.go.th/. This database enables users to conduct searches for both word marks and image marks.
 
The image search system is generated by AI and enables searches by uploading an image or logo specimen. In addition, searches may also be conducted using the Vienna Classification code.

Searching by uploading images
 
You may upload your logo to conduct a survey of identical or similar trademarks in the Thai DIP database. The system is capable of detecting similarities in both images and word elements. In particular, if your logo contains word components, the AI-powered image search will also analyze and compare similar fonts, making it a valuable tool for identifying potential conflicts beyond visual resemblance. Searches may be conducted across all classifications or limited to specific classes for more targeted results. Additionally, the results are presented in order of similarity, from most similar to least similar.
 
However, the search results are indicative rather than exhaustive, as newly filed applications (within the past 7 days) may not yet be included in the database. While the image search provides a strong indication of potential similarities, if your logo contains word elements, an additional word search is recommended to achieve greater accuracy and comprehensive coverage.

Searching using the Vienna Classification Code
 
For a more detailed search, using the Vienna Classification code can provide more accurate results. You can search by entering the appropriate code. For example, for a trademark that includes a lion, the relevant code is 3.1.1. This search will display all applications that include a lion in their design.
 
Searching by Vienna code tends to lead to more up-to-date and detailed results than searching by image. However, the results will include all designs containing the specified element, without distinguishing whether they are identical or similar to your trademark.

Searching by image is an essential step before filing a trademark in Thailand. It can detect similarities in both logos and word elements, allowing you to identify and resolve potential conflicts before filing your application. While not fully exhaustive, it provides a good overview and is especially effective when combined with a careful search of word components.
